Abstract

The aim of this paper is to show the role of pain in Alessandro Levi’s philosophy of law. Levi, Roberto Ardigò’s scholar, studied in Padua and was a member of the last generation of positivists that experienced the crisis of the movement itself. With the raise of neo-idealism, positivism waned in Italy, nevertheless its exponents continued to contribute with their studies and works to the advancement of Italian culture. During his scientific production, Levi highlighted the role of pain in our legal and political construction and also stressed out its importance in human relationships. According to him, pain is the most important phenomenon in psychology and plays a crucial role in the society’s construction during the centuries
